FREE CEU Tuesday, September 24:
Create an Estate Plan that also serves as a Long-Term Care Plan
Sponsored by Alliance Homecare
Tuesday, September 24, 5:00 - 7:00 PM
An estate plan expresses and implements people’s wishes regarding the distribution of their assets upon their death.
Unfortunately, ruinous long-term care costs can consume their entire life savings, leaving little or nothing in their estates to distribute. This issue places most seniors in serious jeopardy, including social workers’ clients or patients.
Fortunately, a long-term care plan created by a knowledgeable Elder Law attorney can also serve seamlessly as an estate plan. Taking the appropriate steps maximizes the likelihood that your clients or patients will have an estate to leave to their family members or other beneficiaries.
Learn how integrating a long-term care plan with an estate plan can protect your clients’ assets and lifestyle while they are alive. If they need long-term care, they can access government programs such as Medicaid to help pay for care, and maintain their lifestyle as long as possible. We will also explain how long-term care planning can replace the need for all but a very simple Will in most cases.
This course will provide 2.0 CEU credits to NYS Licensed Social Workers only

Planning for Home Care in New York State
Sponsored by Community Care Home Health Services
Tuesday, June 25, 5:00 - 7:00 PM
Most people don't realize how devastating the costs of long-term care can be until they start needing care. Guiding clients on how to protect themselves and seek help has never been more important. The earlier they start planning, the better.
Social workers will learn how to explain to their clients that planning can enable them to remain at home and maintain their lifestyle as long as possible. Often Community Medicaid is an important part of that equation. How to find and access care are also key issues.
Learn about the changes Community Medicaid has undergone in the past few years, and about new, additional changes that are anticipated. Lamson & Cutner attorneys will discuss how to gain eligibility, protect assets and income, and obtain the proper level of care once eligibility has been established.
A representative from Community Care Home Health Services will discuss how to start the process of finding home health care through New York's Consumer Directed Personal Assistance Program ("CDPAP"). They will also talk about some of the devastating changes that NY State is trying to impose on CDPAP.
With knowledge about your clients’ possible legal options and opportunities, you will be in a good position to provide guidance on when obtaining legal advice is important and appropriate. At the same time, you should refrain from providing any legal advice. Don’t let the desire to be helpful overcome the caution you should bring to any discussion about legal action.
This course will provide 2.0 CEU credits to NYS Licensed Social Workers only

How to Plan for Long-Term Care, and How to Find and Access Care
May 29, 1:00 - 2:00 PM
Hosted by PSS Life! University
Most people will need some kind of long-term care at some point. Unfortunately, it is ruinously expensive, and it’s not covered by Medicare or any other medical insurance. In New York, proper planning can protect your assets and your income, and can provide access to the Medicaid program, which does cover long-term care. Applying for Medicaid, and, once approved, accessing the care you want and need, can be a daunting project. Experienced advice and assistance can help ensure the process goes as quickly and as smoothly as possible, often saving you a significant amount of time and money.
Lamson & Cutner attorney David Cutner will describe how Elder Law planning can protect your property and life’s savings, and help you achieve Medicaid eligibility at the same time. Learn about your options, and make an informed decision, even if you think (incorrectly) that you cannot qualify.
Tara Lovett, L&C’s Director of Client Care and Advocacy, will discuss programs that are available for long-term care, and how to begin the process of finding the care you need. She will discuss aides, assisted living versus nursing home, and the Nursing Home Transition and Diversion (NHTD) program, which is designed for seniors who want to stay home even when they require a high level of care.
Tara is Lamson & Cutner’s first Director of Client Care and Advocacy. In this position, Tara assists clients with vital decisions and actions regarding their health care and long-term care options.

Estate Planning and Advance Directives,
Including the Power of Attorney (POA) and Health Care Proxy (HCP)
June 5, 5:00 - 7:00 PM
Estate planning is important for everyone, including social workers’ and case managers’ clients. Most people are unaware of all the issues that should be considered, or of the different options that may be available to them.
For those who already have estate planning documents, there are important reasons why these documents should be reviewed and updated from time to time. In many cases, their life circumstances, or those of their children or other beneficiaries, may have changed over time. In some cases, your clients may need to take steps to avoid or limit estate taxes. Crucially, all except extremely wealthy people are vulnerable to financial ruin if they do not have a long-term care plan. Learn how, in most cases, a long-term care plan can be seamlessly integrated with an effective estate plan. The course will also discuss why a robust Power of Attorney and a Health Care Proxy are essential documents for every adult.
This program will inform you about your clients’ possible legal options in connection with Estate Planning and other legal matters. With this knowledge, you will be better able to provide guidance about when it is important and appropriate for them to consult with an Elder Law attorney. It is important for non-lawyers to avoid providing advice about legal matters, and you don’t want to let the desire to be helpful overcome the caution you should bring to any discussion about legal rights and options.
This course will provide 2.0 CEU credits to NYS Licensed Social Workers. Authorization to grant CE credits to Case Mangers with the CCM designation is in process.

Community Medicaid 2024, Including Home Care, ALPs, and Pooled Income Trusts
Free CEU Sponsored by The Bristal and 305 West End Assisted Living
May 7, 5:00 - 7:00 PM
Many Social Work clients will need expensive long-term care services in the home. Guiding clients on how to protect themselves and seek help has never been more important.
Numerous changes to the rules and procedures for Community Medicaid have been made in the past few years. Learn how these changes have impacted eligibility, protection of assets and income, and obtaining the proper level of care once eligibility has been established.
This course will explain the strategies Medicaid applicants can use to protect their life’s savings, so they can remain in their homes as long as possible without becoming impoverished. Also, learn how to start the process of finding home health care through an agency or CDPAP, or how to find the assisted living residence that best suits a client’s needs.
This program will inform you about your clients’ possible legal options in connection with Medicaid benefits and other legal matters.
This course will provide 2.0 CEU credits to NYS Licensed Social Workers and Case Managers with the CCM designation.

"Nursing Home Medicaid Update 2023" Sponsored by The Bristal and 305 West End Assisted Living
Tuesday, July 18, 2:00 – 4:00 pm via Zoom
This program will explain how Nursing Home Medicaid differs from Community Medicaid, the rules for Medicaid Nursing Home eligibility, and issues related to the resident’s income and spousal income. We will also cover aides in the Nursing Home and the Nursing Home Transition and Diversion (NHTD) program.
Most importantly, we will discuss how your clients can protect a good portion of their assets, even if no planning was done before nursing home care was needed.
Why Lamson & Cutner believes that educating yourself about long-term care is crucial to your wellbeing
Lamson & Cutner strongly believes that too many elderly and disabled people forego benefits and opportunities that would dramatically improve their health care and their quality of life. Many deplete their life’s savings by private paying for long-term care, when assistance could easily be obtained at little or no cost.
All too often, the reason is lack of knowledge, and not knowing where to turn to find out.
The Elder Law attorneys at Lamson & Cutner devote a good deal of their time to providing free seminars and public presentations to address these issues, and to answer questions that people want to ask. Typically, these presentations involve topics such as eligibility requirements and strategies for obtaining Medicaid home care or Medicaid nursing home care, trusts to hold real estate or financial assets, pooled income trusts, supplemental needs trusts for the disabled, the durable power of attorney, the health care proxy and the living will, and estate planning.
Lamson & Cutner attorneys are much sought-after by senior centers, charitable and religious organizations, and nursing homes and hospitals, to speak to their members or their staff. Those who have some familiarity with Elder Law topics, or have listened to other speakers, frequently say that they have never heard anyone explain this subject matter in such a clear and understandable way.
This is what one satisfied presentation attendee said:
Just a quick thank you once more for taking the time to speak to the social work dept’ today. I’d like you to know that throughout the rest of the day, virtually every single one of my colleagues – as well as my supervisor and assistant director – stopped me to say how informative your presentation was, and to comment on the ease in which you imparted your knowledge and competence in an area that often comes up in our line of work.” – K.S., LMSW, Roosevelt Hospital – Department of Social Work
